Terms of Use
Welcome to YesCheck. YesCheck is a product of Think Ahead B.V. ("YesCheck", "we", "us"). These terms apply to use of both our marketing website (yescheck.io) and the YesCheck platform (staging.yescheck.io and, after go-live, the production environment). By visiting the website or using the platform, you agree to these terms.
For business customers with a platform subscription, these terms together with a signed Data Processing Agreement (DPA) and an individual Service Order form the complete agreement. This page remains publicly accessible at all times.
1. Use of the website
You may use the website for personal and business information purposes. You may not use the site in a way that disrupts its operation, hinders other visitors, or violates the law. Automated scraping, reverse engineering, and bypassing security measures are not permitted.
2. Use of the YesCheck platform
2.1 What YesCheck is
YesCheck is a SaaS platform that, on behalf of your organisation, connects to Google Ads through the Google Ads API and presents AI-generated recommendations (search-term review, cannibalisation detection, PMAX overlap, account audits and similar optimisations). Changes to Google Ads are only executed after an authorised user explicitly approves them in the YesCheck UI. Automated execution without human approval is disabled.
2.2 Who may use the platform
The platform is intended for business users (B2B): agencies, in-house performance teams and advertisers managing Google Ads campaigns. By using the platform you represent that:
- you are at least 18 years old and authorised to enter into contracts on behalf of your organisation;
- you are lawfully authorised to manage the Google Ads accounts you connect — as owner, or as an authorised manager via Google's MCC model or an equivalent arrangement;
- where the Google Ads account holder is a party other than yourself, you have informed them of the use of YesCheck.
2.3 Access and accounts
Access to the platform is granted via a demo followed by a paid subscription, or via a pilot/proof-of-concept on an individual basis. Authentication uses Google Sign-In tied to an organisation-scoped tenant. You are responsible for keeping your login credentials secure and for all activity that occurs within your account. Report any suspected unauthorised use immediately to security@yescheck.io.
2.4 Acceptable use
You must not use the platform to:
- connect Google Ads accounts for which you do not have valid authorisation;
- exfiltrate data from the platform for purposes that conflict with the Google Ads terms applicable to the account holder;
- load the platform or the Google Ads API in a way that falls outside normal use (bypassing rate limits, mass export, scraping other tenants);
- create or modify Google Ads accounts or campaigns programmatically without a human user approving each change through the YesCheck UI;
- run unlawful campaigns, misleading ads, or content that violates Google Ads policies;
- reverse engineer, decompile or bypass security measures;
- resell the platform or any component, or offer it as a white-label SaaS, without our prior written consent (this falls under a separate Agency/Reseller agreement).
In case of breach we may suspend or terminate access for the user or tenant immediately, without prejudice to any outstanding fees.
2.5 Google API Services User Data Policy & Limited Use
YesCheck's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
In concrete terms: we only use Google user data to provide or improve features visible in the YesCheck UI, do not transfer this data to third parties for advertising purposes, do not sell data, do not train AI models on your data, and do not allow human access except under the exceptions set out in §4a of our privacy policy. 2.6 Availability and changes to the platform
We make reasonable efforts to keep the platform available 24/7 but do not provide an uptime guarantee beyond what is explicitly agreed in a Service Order or SLA. We may temporarily pause the platform for maintenance; scheduled downtime is announced in advance. We may add, modify or remove functionality; material changes affecting existing use are communicated in advance.
2.7 Termination and data return / deletion
A subscription runs for the term set out in the Service Order and, unless otherwise agreed, is cancellable monthly on monthly billing and annually on yearly billing (no automatic renewal). Termination must be made in writing via info@yescheck.io. On termination:
- we block platform access on the end date;
- you have 30 days to request a data export (CSV/JSON of the relevant components);
- we then delete all personal data and Google user data following the process in §9a of our privacy policy;
- audit log entries that must be retained for legal or contractual reasons remain in pseudonymised form for as long as necessary.
2.8 Liability for the platform
To the extent permitted by law, the liability of Think Ahead B.V. is capped at the fees paid by you to us in the 12 months preceding the event giving rise to the claim, except for damages caused by our intent or gross negligence. We are not liable for indirect damages, lost revenue, lost profits, loss of data outside our reasonable control, or damages resulting from decisions you execute in Google Ads based on YesCheck recommendations — all recommendations are proposals that you approve or reject.
3. Intellectual property
All content on this website, and all software, models, prompts, dashboards and data schemas that make up the YesCheck platform — including text, images, logos, video, code and design — are the property of Think Ahead B.V. or our licensors and protected by copyright and other intellectual property rights. Using the platform grants you a non-exclusive, non-transferable right of use for the duration of the subscription. You may not copy, distribute, reuse or publish content or platform components without our prior written consent, except for normal browsing and sharing links.
Data that you bring into the platform, or that we retrieve from Google Ads on your behalf, remains the property of your organisation (or the Google Ads account holder). YesCheck only obtains a processing right for the duration of the agreement, limited to the purposes set out in our privacy policy and the DPA.
4. Information on the website and platform
We do our best to provide accurate and up-to-date information, but cannot guarantee that all information or every AI-generated recommendation is always complete or error-free. Recommendations are proposals based on data analysis, not advice you should act on without your own assessment. No rights can be derived from the content of the website. Product features, pricing and availability may change.
5. External links and services
The website and platform link to external services — including Cal.com for scheduling demos, Google for authentication and the Google Ads API, Stripe for billing and Anthropic for AI analyses. A current list is on our subprocessors page. We are not responsible for the content or operation of these external services.
6. General liability
To the extent permitted by law, Think Ahead B.V. is not liable for direct or indirect damages arising from the use of, or inability to use, the website or platform, including damages caused by viruses, interruptions, inaccurate information, or the execution of AI recommendations without independent assessment. The platform-specific liability cap in §2.8 applies to platform-related claims.
7. Changes to these terms
We may update these terms. The most recent version is always available on this page, with the last-updated date at the top. We notify active customers of material changes that affect existing use at least 30 days in advance by email. Continued use of the site or platform after a change takes effect means you accept the updated terms.
8. Governing law and disputes
These terms are governed by Dutch law. Disputes are submitted to the competent court in the district where Think Ahead B.V. is established, unless mandatory law designates a different court.
